Wealth Management – Mutual Funds User Agreement

Neither Bitget, nor any of our affiliates or representatives, make any representation or warranty that Wealth Management - Mutual Funds products/services is suitable or appropriate, for any user or in any location, nor that the transactions and described in this Wealth Management - Mutual Funds User Agreement (this “Agreement”) are (or will continue to be) available or appropriate for any user or in any location. You are strongly encouraged to carefully review this Agreement and seek independent professional advice as to whether Wealth Management - Mutual Funds products/services is appropriate for you having regard to your personal circumstances and objectives, financial position and risk tolerance level.

By subscribing to, purchasing or otherwise engaging in Wealth Management - Mutual Funds products/services, you: (i) acknowledge and agree that you will be bound by and will comply with this Agreement, as updated and amended from time to time; and (ii) agree that you have read and understood the terms in this Agreement. If you do not understand and accept the terms in this Agreement in their entirety, you should not (x) subscribe to, purchase, hold, use or otherwise acquire Wealth Management - Mutual Funds products or (y) engage in Wealth Management - Mutual Funds services in any form.

This Agreement is supplemental to and shall be read together with the Bitget Terms of Use (“Terms of Use”) and the terms of the Futures Services Agreement, which shall continue to apply. All terms and clauses contained in the Terms of Use and the Futures Services Agreement (except to the extent expressly modified herein) are incorporated by reference and have the same force and effect as if set out in their entirety in this Agreement. This Agreement constitutes Product Terms. References in the Terms of Use to the Services shall include references to this Agreement contemplated hereunder.

In the event of any conflict or inconsistency between this Agreement, the Terms of Use and the Futures Services Agreement, this Agreement shall prevail, unless expressly stated otherwise. We may make changes to this Agreement (or any terms or information incorporated by reference) at any time in accordance with the Terms of Use.

1. Definitions

Lock-up Period means the pre-determined period for which your Digital Assets must be subscribed to and maintained as Wealth Management – Mutual Funds and not Redeemed.

Minimum Investment Amount means the minimum amount of investment token which you must subscribe to.

Redeem means ending your participation in the Wealth Management – Mutual Funds products in respect of all or part of your Wealth Management – Mutual Funds Assets, by requesting the return of such Wealth Management – Mutual Funds Assets in accordance with this Agreement, and “Redemption” shall be construed accordingly.

Wealth Management – Mutual Funds Assets means the Digital Assets used by you to Subscribe for Wealth Management – Mutual Funds.

2. Eligibility

2.1 The Wealth Management – Mutual Funds products are only available to certain users in certain countries. Such products are not intended for users/countries to which restrictions/prohibitions apply.

2.2 Bitget reserves the right to adjust the eligibility requirements of the Wealth Management – Mutual Funds products from time-to-time. Without prejudice to our rights under this Agreement, the Terms of Use and the Futures Services Agreement, if you cease to be eligible, we may exercise our right to suspend and/or terminate your subscription.

3. Subscription

3.1 You may from time to time subscribe to the Wealth Management – Mutual Funds products on the Platform or otherwise made available to you by us.

3.1 You understand and agree that:

(a) each subscription of the Wealth Management – Mutual Funds products may be subject to a Minimum Investment Amount;

(b) you are not entitled to early redemption or early termination of your subscription to the Wealth Management – Mutual Funds products; and

(c) in the exceptional event where we consent to your request for early redemption or early termination, we will charge you and you will pay us an exit fee as determined by us in our sole and absolution discretions subject to the then-current market condition and prices. You also understand and acknowledge that you may suffer substantial losses.

3.3 Bitget reserves the right to refuse, suspend or cease any subscription to the Wealth Management – Mutual Funds products (in part or in whole), at any time and for any reason, without liability to you, if we determine in or sole discretion, it is necessary or desirable to protect the integrity, security, or reputation of the Platform or related services, to comply with Applicable Laws or any other reasons as we think fit.

4. Lock-up Period

4.1 Wealth Management – Mutual Funds Assets cannot be Redeemed until the end of the relevant Lock-up Period.

5. Redemption

5.1 Subject to any applicable restrictions that may apply from time-to-time, you shall have the right to redeem your Wealth Management – Mutual Funds Assets on the Platform.

5.2 Bitget reserves the right to apply redemption restrictions or conditions from time-to-time, with or without notice, to the extent it deems appropriate in its sole discretion, including, without limitation, to facilitate compliance with Applicable Laws or to protect the security, integrity or reputation of the Platform.

6. Disclosure and Consents

You hereby acknowledge, confirm your understanding, and agree that:

6.1 there may be restrictions on subscription and redemption;

6.2 you are exposed to the credit and operational risk of Bitget by holding the Wealth Management – Mutual Funds products. In the event of Bitget’s insolvency or operational failure, you may be unable to redeem the Wealth Management – Mutual Funds products;

6.3 third parties, such as payment providers, custodians and banking partners, may be involved in the provision of the Wealth Management – Mutual Funds products or otherwise the Services. You may be subject to the terms and conditions of these third parties, and Bitget may not be responsible for any loss that these third parties may cause to you;

6.4 in extreme or exceptional circumstances, Bitget’s ability to promptly fulfill redemption requests may be adversely affected — including, without limitation, in cases of large-scale redemption requests requiring Bitget to rebalance or liquidate assets. During such periods, you may not be able to access the corresponding Wealth Management – Mutual Funds Assets immediately. Redemption restrictions may also be imposed in response to market volatility, liquidity constraints, or other operational or legal considerations, and may result in delays or losses;

6.5 the Wealth Management – Mutual Funds Assets or otherwise Digital Assets may decrease in or lose all of its value due to various factors, including but not limited to the discovery of wrongful conduct, market manipulation, change in the nature or properties of the Digital Asset, governmental or regulatory activity, legislative changes, suspension or cessation of support for Digital Assets or other exchanges or service providers, public opinion, or other factors outside of our control. Technical advancements, as well as broader economic and political factors, may cause the value of Digital Assets to change significantly over a short period of time;

6.6 the Bitget: (i) subscription rules, (ii) redemption rules, (iii) maturity rules and (iv) distribution rules (as applicable and in effect from time to time) shall apply to the Wealth Management – Mutual Funds products; and

6.7 the subscription, purchase or otherwise engagement of the Wealth Management – Mutual Funds shall be governed by documentation and operational guidelines as updated from time to time and/or as displayed on the relevant product subscription page; and

6.8 Bitget reserves the right, in its sole and absolute discretion, to modify, suspend, or restrict (as the case may be) the uses, valuation or functionalities of the Wealth Management – Mutual Funds products at any time, with or without prior notice.

7. Liability

The following is a summary of certain key risks associated with the Wealth Management - Mutual Funds products. This summary is not exhaustive and does not capture all possible risks that may arise. You are solely responsible for assessing whether Wealth Management - Mutual Funds products is suitable for you.

7.1 By subscribing to, purchasing or otherwise engaging in Wealth Management - Mutual Funds products, you acknowledge, understand and accept all the risks arising out of participating in Wealth Management - Mutual Funds products including those set out in Risk Disclosure and this Clause. You confirm that you have carefully assessed whether, and determined that, Wealth Management - Mutual Funds products are appropriate for you.

7.2 The regulatory environment surrounding Digital Assets is subject to change, and any adverse regulatory actions or new laws may impact the operation, performance or offering of Wealth Management - Mutual Funds products.

7.3 In no event will Bitget or any of its Affiliates be responsible or liable to you or any other person or entity for any direct or indirect losses (including loss of profits, business or opportunities), damages, or costs arising out of or in connection with any risk identified in this Agreement. This limitation of liability is in addition to the limitation of liability contained in the Terms of Use.

Bitget or the responsible third party custodians maintain full custody of the Digital Assets and user data/information which may be turned over to governmental authorities in the event of suspension, limitation or termination arising from fraud investigations, investigations of violation of law or violation of these Terms. Bitget will not be liable to you and/or any third party for loss or damage suffered due to delay, transmission errors, technical faults or defects, breakdowns and illegal intrusion or intervention in the information provided and services offered, or any failures or delays in completing any transactions. Bitget will not be liable for any loss or damage suffered due to delays, technical faults or interruptions in the availability of the Platform, or any Services.
