Meta reportedly faces compliance concerns for applying for multi-billion dollar tax incentives for AI data centers

According to The New York Times, Meta is leveraging the U.S. research and development tax credit policy to apply for billions of dollars in tax breaks for its artificial intelligence data centers. The company has described its multibillion-dollar data center projects as “experimental research and development activities,” and claims that AI computing chips purchased from suppliers such as Nvidia are investments in experimental projects, thereby qualifying for the credit. Documents show that last year, these policies helped Meta reduce its tax burden by nearly $4 billion, making it one of the biggest beneficiaries of this tax credit among publicly listed companies. However, Meta's internal accountants have warned that this approach carries legal risks, and the Internal Revenue Service may challenge the relevant applications. Andre Shevchuck, a partner at tax consultancy BPM, stated that classifying AI data centers as R&D experimental projects is “beyond the norm.” The IRS has previously reviewed companies' practices of including ordinary business expenditures within the scope of R&D credits.
