SBF withdraws Motion for Reconsideration, requests new judge for "Fair Hearing"
BlockBeats News, April 23rd, FTX founder SBF temporarily withdrew the motion for a new trial in a letter to New York Judge Lewis J. Liman, stating that he believed he could not receive a "fair hearing" from the judge.
In a letter filed with the United States District Court for the Southern District of New York on Wednesday, SBF stated that he had been focused on responding to questions raised by Judge Liman, including whether his attorney had written the motion filed under Federal Rule of Criminal Procedure 33 (i.e., the request for a new trial).
"Because I had to focus on addressing these issues rather than drafting a response to the prosecution's opposition, and because I do not believe I can receive a fair hearing on this issue before you, I now request the withdrawal of the Rule 33 motion, without prejudice to refile the motion after resolution of my direct appeal and related requests for a new judge," SBF stated.
