Clarity Act Update for XRP Army: What to Expect If Closure Vote Fails to Happen This Week
The CLARITY Act has 51 confirmed votes out of 60. The Senate leaves for August recess on August 8, and all eyes are on the Senate right now. Crypto pundit BankXRP shared a video featuring Andy Baehr, Managing Director of Asset Management at GSR, who laid out the situation.
Baehr noted that a vote must happen before the Senate departs if the bill is to have any chance of passing in August. Without it, the timeline slips. Prediction markets currently put the odds of passage this year at roughly 30%.
Baehr said “time is running awfully short,” and suggested it could slide to September if a vote doesn’t happen this week. He added that the crypto market would treat any progress on the CLARITY Act as a positive surprise.
Democrats Moving Toward Support
The vote count has shifted meaningfully. Bloomberg congressional reporter Steven Dennis confirmed that 7 to 10 Democrats are now ready to vote for the CLARITY Act. Just 9 of these votes would place the bill at the 60-vote threshold.
XRP holders and the broader community have been calling on the Senate to pass the CLARITY Act. The bill establishes a legal distinction between digital assets classified as commodities and those classified as securities. It sets clear regulatory jurisdiction, and XRP could benefit significantly because it already has regulatory clarity.
The Cost of Failure
Senator Cynthia Lummis has been explicit about what happens if the bill misses this window. She has warned that a failed vote pushes crypto regulation all the way to 2030. The 2026 election calendar compresses available Senate floor time to near zero. A new Congress of unknown composition could take over after the midterms, forcing the process to start over.
Baehr echoed the urgency. If cloture does not happen before the recess, he said there may be a window in September, but it is narrower with every passing day. The bill has sat on the Senate Legislative Calendar since June, eligible for a vote, held back by ethics disputes and procedural delays, including the Senate’s prioritization of other legislation.
The Path Forward
Major financial institutions have lined up behind the CLARITY Act. BlackRock, Goldman Sachs, Fidelity, Franklin Templeton, and SoFi have all publicly backed the legislation. The policy case for the bill is not in serious dispute. What remains is floor time and the 60-vote threshold. If the vote doesn’t happen this week, market participants will be looking to September.
