Expert Says “CLARITY Passes or Fails Doesn’t Really Change XRP’s Setup”. Here’s why

XRP has already secured something most crypto assets have not. A court ruling established XRP’s legal status, and that precedent holds regardless of what happens in the Senate.

Crypto commentator BankXRP (@BankXRP) made that case, arguing that the CLARITY Act’s passage or failure does not alter XRP’s fundamental position.

His position rests on the fact that XRP fought its legal battle and won. That outcome does not disappear based on legislative outcomes. “That ruling isn’t going anywhere regardless of what Congress does,” he wrote.

Either Way, XRP Wins

BankXRP laid out both scenarios. If the CLARITY Act passes, XRP benefits alongside every other digital asset that gains regulatory clarity. If it stalls, XRP stands in a different position entirely. It becomes the one asset institutions can point to as already tested in court.

“Either way, XRP wins the waiting game,” he wrote. The argument is not that the CLARITY Act is irrelevant. It is that XRP’s legal foundation gives it an advantage that exists independently of the bill’s fate. Other assets are waiting for Congress to define their status. XRP already has a judicial record.

A Counterpoint Worth Noting

Not everyone agrees with that read. Vincent Van Code (@vincent_vancode), a software engineer and well-known figure, pushed back. He noted that the court ruling was issued at the district level, which carries limitations. A district court decision does not prevent future enforcement actions against Ripple or other crypto projects. Only legislation passed into law can provide that level of protection.

Van Code’s position is that statutory clarity is the only reliable shield against future enforcement. The court win is meaningful, but it is not a permanent resolution on its own.

The Current State of the Bill

The CLARITY Act currently has 51 confirmed or likely yes votes in the Senate. It needs 60 to advance. Republican support is unified. The remaining votes must come from Democrats. Only 12 Senate Democrats have publicly declared opposition. The other 33 have made no public statement. The bill needs just 9 of those 33 to cross the threshold.

Senate Majority Leader Thune confirmed a floor vote will happen before the recess on August 8. CNBC reported that Thune intends to bring the bill to a vote whether or not the votes are secured, to put every senator on record.

The August deadline now shapes everything. If the bill fails to advance before recess, the path forward becomes significantly harder heading into November’s midterm elections.
